A recent federal regulation aims to ensure compliance with current gun laws. The Justice Department introduced the “Engaged in the Business” Final Rule in the Federal Register, requiring individuals selling guns for profit to be licensed and conduct background checks, regardless of the sales venue. Attorney General Merrick Garland emphasized this in a press release earlier this week.

This regulation follows an executive order from President Joe Biden in March 2023, directing the Attorney General to clarify the definition of individuals engaged in firearm dealing and the necessity of obtaining a federal firearms license. The regulation arrives shortly before the Syracuse Spring Gun Show, organized by the New York State Sportsmen Association at the New York State Fairgrounds.

Organizer Marcus Loveland stated that their event, which prioritizes safety, has long adhered to the rules and regulations outlined in the federal requirement. He emphasized the importance of compliance and safety measures, including monitoring vendors and patrols in the parking lot to prevent illegal transactions.

While the new regulations may slightly increase the compliance burden for casual firearm sellers, firearm policy expert Scott Armstrong believes it might not significantly impact gun owners due to the rigor of existing gun laws in New York State. However, he worries that the regulation may not effectively address gun violence, as regulating the intent of individuals involved in illegal activities is challenging.
